Juantasker Waiver and Release of Liability

Effective Date: June 2026

This Waiver and Release of Liability ("Agreement") is entered into by and between the user ("User") and Juantasker ("Company," "Platform," or "Juantasker").

By creating an account, accessing the Platform, requesting services, offering services, accepting tasks, or otherwise using Juantasker, the User acknowledges and agrees to the following:

1. Acknowledgment of Platform Role

The User understands and agrees that Juantasker is solely an online marketplace that connects individuals and businesses seeking services ("Clients") with independent service providers ("Taskers").

Juantasker does not employ, supervise, direct, control, train, manage, or guarantee the performance of any Tasker.

Juantasker is not a contractor, subcontractor, employer, staffing agency, labor provider, or service provider.

Any service arrangement entered into through the Platform is solely between the Client and the Tasker.

2. Assumption of Risk

The User voluntarily assumes all risks associated with the use of the Platform and any services arranged through the Platform, including but not limited to:

  • Property damage;
  • Personal injury;
  • Death;
  • Theft;
  • Fraud;
  • Misrepresentation;
  • Unsatisfactory work;
  • Incomplete work;
  • Delayed work;
  • Negligence of another user;
  • Financial losses;
  • Business interruption;
  • Loss of profits;
  • Loss of data.

The User acknowledges that interactions with other users may involve risks that cannot be entirely eliminated.

3. Release of Liability

To the fullest extent permitted by law, the User hereby releases, waives, discharges, and forever holds harmless Juantasker and its owners, shareholders, officers, directors, employees, affiliates, agents, representatives, successors, and assigns from any and all claims, demands, causes of action, liabilities, damages, losses, judgments, costs, and expenses arising out of or relating to:

  • Services performed through the Platform;
  • Failure to perform services;
  • Defective or unsatisfactory services;
  • Injuries or damages occurring during a task;
  • Property damage;
  • Theft or loss of property;
  • Accidents;
  • Disputes between users;
  • Breach of contract between users;
  • Acts or omissions of any Client or Tasker.

4. No Warranty

The User acknowledges that Juantasker makes no representation or warranty regarding:

  • The competence of Taskers;
  • The quality of services;
  • Completion of tasks;
  • Suitability of users;
  • Accuracy of profile information;
  • Safety of services;
  • Availability of the Platform.

All services are arranged at the User's own risk.

5. Client Acknowledgment

Clients understand and agree that:

  • They hire Taskers at their own discretion and risk;
  • They are responsible for evaluating whether a Tasker is suitable for a task;
  • Juantasker does not guarantee the results of any service;
  • Any dispute regarding services must be resolved directly with the Tasker.

6. Tasker Acknowledgment

Taskers understand and agree that:

  • They are independent contractors and not employees of Juantasker;
  • They are solely responsible for their actions and conduct;
  • They are responsible for obtaining any required permits, licenses, certifications, and insurance;
  • They are solely responsible for taxes and statutory obligations;
  • They perform tasks at their own risk.

7. Indemnification

The User agrees to defend, indemnify, and hold harmless Juantasker and its affiliates from and against any claims, liabilities, damages, losses, costs, penalties, judgments, and expenses, including reasonable attorney's fees, arising from:

  • The User's conduct;
  • The User's negligence;
  • The User's violation of law;
  • Services requested or performed through the Platform;
  • Any dispute between a Client and a Tasker.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUANTASKER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE TOTAL PLATFORM FEES PAID BY THE USER TO JUANTASKER DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

UNDER NO CIRCUMSTANCES SHALL JUANTASKER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

9. Medical and Emergency Responsibility

Taskers acknowledge that some tasks may involve physical activity or potentially hazardous conditions.

Taskers voluntarily assume all risks associated with performing services and are responsible for obtaining their own medical, health, disability, accident, and liability insurance coverage.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any dispute involving Juantasker shall be brought exclusively before the appropriate courts of the Philippines.

11. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Electronic Acceptance

The User agrees that checking an acceptance box, creating an account, using the Platform, requesting services, accepting tasks, or continuing to use Juantasker constitutes an electronic signature and legally binding acceptance of this Waiver and Release of Liability.

User Acknowledgment

BY USING JUANTASKER, I ACKNOWLEDGE THAT:

  • I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY;
  • I FULLY UNDERSTAND ITS TERMS;
  • I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS;
  • I AGREE TO BE LEGALLY BOUND BY ITS TERMS;
  • I RELEASE JUANTASKER FROM LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
