Juantasker Terms and Conditions

Welcome to Juantasker ("Juantasker," "Platform," "Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Juantasker website, mobile applications, and related services.

By creating an account, accessing, or using Juantasker, you agree to be bound by these Terms.

1. Nature of the Platform

Juantasker is an online marketplace that connects individuals and businesses seeking services ("Clients") with independent service providers ("Taskers").

Juantasker does not perform tasks or services directly. The Platform merely facilitates introductions, communication, booking, payment processing, and related marketplace services between Clients and Taskers.

2. Eligibility

To use Juantasker, you must:

  • Be at least eighteen (18) years old;
  • Have the legal capacity to enter into contracts;
  • Provide accurate and complete registration information;
  • Comply with all applicable laws and regulations.

3. Independent Contractor Relationship

Taskers using the Platform are independent contractors and are not employees, agents, representatives, partners, or joint venturers of Juantasker.

Nothing in these Terms shall be construed as creating:

  • An employer-employee relationship;
  • A partnership;
  • A joint venture;
  • An agency relationship;
  • A franchise relationship.

Taskers retain sole control over:

  • The manner in which services are performed;
  • Their schedules and availability;
  • Their tools, equipment, and materials;
  • Pricing, where applicable;
  • Acceptance or rejection of tasks.

Taskers are solely responsible for their taxes, permits, licenses, insurance, and compliance with applicable laws.

4. Client Responsibilities

Clients agree to:

  • Provide accurate task descriptions;
  • Maintain a safe working environment;
  • Communicate honestly with Taskers;
  • Pay all agreed fees and charges;
  • Refrain from fraudulent, abusive, or illegal conduct.

Clients acknowledge that they are contracting directly with the Tasker and not with Juantasker.

5. Tasker Responsibilities

Taskers agree to:

  • Perform services professionally and lawfully;
  • Provide truthful profile information;
  • Maintain required licenses and permits where applicable;
  • Comply with all applicable laws and regulations;
  • Complete accepted tasks in a timely and competent manner.

6. Bookings and Payments

Juantasker may facilitate payment processing between Clients and Taskers.

The Company may charge service fees, platform fees, commissions, or other charges as disclosed through the Platform.

All payments made through Juantasker are subject to applicable processing fees and refund policies.

7. Cancellations and Refunds

Cancellation and refund eligibility shall be governed by Juantasker's applicable cancellation and refund policies, which may be updated from time to time.

Juantasker reserves the right to determine refund eligibility in cases involving disputes, fraud, abuse, or violations of these Terms.

8. User Content

Users retain ownership of content they upload to the Platform, including:

  • Photos;
  • Reviews;
  • Messages;
  • Task descriptions;
  • Profile information.

By posting content, users grant Juantasker a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for Platform operations, marketing, and service improvement.

9. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

JUANTASKER MAKES NO GUARANTEES OR WARRANTIES REGARDING:

  • The quality of services provided by Taskers;
  • The qualifications, suitability, or reliability of Taskers;
  • Completion of any task;
  • Results obtained from services;
  • Availability of the Platform.

Juantasker does not guarantee that any task will be completed successfully or without defects.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUANTASKER, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR:

  • Any failed, incomplete, delayed, or unsatisfactory task;
  • Property damage;
  • Personal injury;
  • Theft or loss of property;
  • Financial loss;
  • Consequential damages;
  • Lost profits;
  • Lost business opportunities;
  • Emotional distress;
  • Indirect, incidental, special, punitive, or consequential damages.

Users acknowledge that any agreement for services is entered into directly between the Client and the Tasker.

Any claims arising from the performance or non-performance of a task shall be pursued directly between the Client and the Tasker.

11. Release of Claims

To the fullest extent permitted by law, Clients and Taskers release Juantasker from any and all claims, demands, damages, disputes, liabilities, and causes of action arising from:

  • Services performed through the Platform;
  • Failure to perform services;
  • User interactions;
  • User conduct;
  • Disputes between Clients and Taskers.

12. Indemnification

Users agree to defend, indemnify, and hold harmless Juantasker and its affiliates from any claims, losses, damages, liabilities, costs, and expenses arising from:

  • Violation of these Terms;
  • Negligence or misconduct;
  • Breach of applicable laws;
  • Services performed through the Platform.

13. Account Suspension or Termination

Juantasker reserves the right to suspend, restrict, or terminate any account at its sole discretion for:

  • Fraudulent activity;
  • Misrepresentation;
  • Abuse of the Platform;
  • Violations of these Terms;
  • Conduct that may harm other users or Juantasker.

14. Intellectual Property

All Platform content, trademarks, logos, software, and branding associated with Juantasker remain the exclusive property of Juantasker and its licensors.

Users may not reproduce, modify, distribute, or exploit any Platform content without prior written permission.

15. Dispute Resolution

Users are encouraged to resolve disputes directly with one another.

Juantasker may, but is not obligated to, assist in dispute resolution.

Any legal dispute involving Juantasker shall be subject to the laws of the Republic of the Philippines and the exclusive jurisdiction of the courts located in the Philippines.

16. Modifications to Terms

Juantasker reserves the right to modify these Terms at any time.

Continued use of the Platform following any update constitutes acceptance of the revised Terms.
